FMLA
The Family and Medical Leave Act (FMLA) is a federal law that allows eligible employees to take unpaid, job-protected leave for certain family and medical reasons while maintaining group health insurance coverage. Click here for the East West Leave Resource Guide.
- Eligibility:
- Must have worked for the employer for at least 12 months and 1,250 hours in the previous 12 months.
- Leave Entitlement:
- Up to 12 workweeks of unpaid leave in a 12-month period for:
- Birth, adoption, or foster placement of a child
- Caring for a spouse, child, or parent with a serious health condition
- The employee’s own serious health condition
- Certain situations arising from a family member’s military service
- Up to 26 workweeks to care for a covered service member with a serious injury or illness.
- Up to 12 workweeks of unpaid leave in a 12-month period for:
- Job Protection:
- Employee must be restored to the same or an equivalent position after returning from FMLA leave.
- Benefits:
- Employer must maintain the employee’s group health insurance under the same terms as if the employee were working.
- Intermittent Leave:
- Can be taken in separate blocks of time or on a reduced schedule when medically necessary.
- Notice:
- Employees must provide notice (typically 30 days if foreseeable)
